1. General

These terms and conditions apply to all offers, orders, and agreements made via our website (https://shop.sodermans.be). By placing an order, you agree to these terms. We reserve the right to modify these terms at any time without prior notice.

2. Ordering and Payment

  • By placing an order, you enter into a binding agreement. You will receive a confirmation of your order by email.
  • Payment must be made at the time of the order, unless otherwise agreed. We offer several payment methods, including Visa, Maestro, Mastercard, Bancontact, KBC, and bank transfer.
  • The payment term is 14 days from the order date. If payment is not received within this period, we reserve the right to cancel the order.

3. Prices and Costs

All prices are in euros and include VAT, unless stated otherwise. Any additional costs, such as shipping costs, will be clearly indicated during the checkout process.

4. Delivery

  • Orders are typically shipped within 1 to 3 working days, unless otherwise indicated on the product page.
  • The delivery of the products will take place at the address you provided when placing the order. We aim to deliver your order as quickly as possible but cannot guarantee the exact delivery time.

5. Right of Withdrawal (Returns)

  • You have the right to withdraw from the contract without giving any reason within 14 days of receiving the goods.
  • To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract through an unequivocal statement (e.g., in writing by post or email). You can use the model withdrawal form, but this is not mandatory.
  • If you withdraw from the contract, we will refund all payments received from you, including delivery costs (excluding any additional costs if you chose a delivery method other than our offered cheapest standard delivery), within 14 days of receiving your withdrawal notification.
  • You are responsible for the costs of returning the goods, unless otherwise agreed.
  • You must return the goods to the address we provide when you exercise your right of withdrawal. The return must take place no later than 14 days after notifying us of your decision to withdraw.
  • We request that you return the items, if possible, in their original packaging. However, you are only liable for any decrease in the value of the goods resulting from use beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

6. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

  • Goods made to your specifications or clearly personalized;
  • Sealed goods which are not suitable for return due to health protection or hygiene reasons and where the seal has been broken after delivery;
  • Goods that, by their nature, are inseparably mixed with other products after delivery.

If any of these exceptions apply to (part of) your order, we will clearly indicate this on the relevant product.

7. Complaints and Disputes

  • If you have any complaints about the products or services we provide, please contact us at [email protected] or +32 11 22 32 17. We will handle your complaint as soon as possible.
  • In the event of a dispute, you have the right to use the European online dispute resolution platform (ODR platform) for mediation or arbitration.

8. Applicable Law

All agreements between the consumer and Sodermans are governed by Belgian law. In the event of a dispute, Belgian courts will have jurisdiction unless otherwise agreed.
